Breath & Blood Tests: DUI Testing is Not Infallible
One of the keys in any successful defense against charges of DWI or DUI is whether your attorney can effectively challenge the breath and blood tests that are being used as evidence in the case. By working with an experienced Baltimore DWI lawyer who has an in depth understanding of the scientific aspects of this type of test, as well as of the best ways to invoke your Constitutional rights, your chances of defeating the prosecution will be much better. When you face harsh DUI/DWI penalties such as jail time, license suspension and steep increases in your insurance premiums, you can't afford not to choose a lawyer who is fully prepared to fight on your behalf.
Breathalyzer tests are in most cases more reliable than field sobriety tests, because they depend less on the opinion of the police officer and more on the equipment. Still, they are not 100% error proof. Improper maintenance and calibration can lead to false readings, and unskilled use of the machine can cause a false positive. Laboratory analysis of blood samples is even more accurate than a breath test, but this is still liable to mistakes in taking the sample, storing and transporting it and in the lab work. Your attorney can investigate the records and subpoena the evidence in order to find any signs that you may have been the victim of errors in testing.
Under Maryland's implied consent law, any licensed driver is required to submit to breath & blood tests when requested to do so by a police officer. The penalty for refusal is a driver's license suspension. One of the major strategies for fighting the charge of drinking and driving is to argue that the defendant's Constitutional rights were violated by an unlawful police stop. If the arresting officer cannot prove probable cause in pulling you over, the results of breath & blood tests could be thrown out as illegally gathered evidence.
