DUI Penalties in Baltimore

DUI and DWI offenses traditionally carry relatively serious penalties. DUI, the more serious of the two offenses, is charged when a person is found driving with a blood alcohol content (BAC) of .08% or more. The penalties for DUI include:

  • First offense - 45-day minimum drivers' license suspension, up to $1,000 in fines, 12 points assessed on one's drivers' license record, and up to 1 year in jail
  • Second offense - Up to $2,000 in fines, 12 points on one's drivers' license record, and up to 2 years in jail

DWI is charged when a person is found driving with a BAC of .07%. The penalties for this offense include:

  • First offense - Drivers' license suspension for up to 60 days, up to $500 in fines, 8 points on one's drivers' license record, and up to 2 months in jail
  • Second offense - Up to $500 in fines, 8 points on one's drivers' license record, and up to 1 year in jail
